Roosevelt Island Tram Update On Agenda For December 11 RIOC Operations Committee Meeting - Over 2,200 People Sign "Trampled By Tourists, Priority Boarding For Residents And Workers On The Roosevelt Island Tram" - Does RIOC Care?

The Roosevelt Island Operating Corp (RIOC) Operations Advisory Committee is meeting 4 PM tomorrow, Wednesday December 11, at 680 Main Street.

Among the items on the Agenda is an Update on Roosevelt Island Tram Operations. 

There is no issue which has decreased the quality of life

and angered more Roosevelt Island residents than the long lines

and unsafe platforms

from overcrowding by 

sightseeing tourists 

on the Roosevelt Island Tram.

In slightly over 1 month's time, 

over 2200 people have signed the Trampled By Tourists, Priority Boarding for Residents and Workers on the Roosevelt Island Tram petition.

According to the Petition organizers:

Roosevelt Island Residents and Workers Need Priority Boarding of the Roosevelt Island Tram

New York Transportation Law § 102

“No common carrier shall make or give any undue or unreasonable preference or advantage to any person or corporation or to any locality or to any particular description of traffic in any respect whatsoever, or subject any particular person or corporation or locality or any particular description of traffic, to any undue or unreasonable prejudice or disadvantage in any respect whatsoever.” 

It doesn’t say there can’t be a preference shown. It says there can’t be an “undue or unreasonable preference”.

The tram is no longer available to residents and workers - it has become a tourist attraction.

It is *reasonable* to give residents and workers priority boarding and return the tram to its original intended use. Urban Transportation.

RI has very limited reliable public transportation options, with over 12,000 residents and hundreds of workers - there's one subway station, with only one line, a very limited ferry service and the tramway. With the tramway inundated by tourists we are left with a single subway station and are facing a transportation crisis, often made worse when there is a subway shutdown.

Further, the RI Tram is funded by the residents through our land leases and not by New York City or New York State.

Our Position

RIOC has taken the position that it would be illegal to offer priority boarding of the Roosevelt Island Tram to island residents and workers based on this:

“No common carrier shall make or give any undue or unreasonable preference or advantage to any person or corporation or to any locality or to any particular description of traffic in any respect whatsoever, or subject any particular person or corporation or locality or any particular description of traffic, to any undue or unreasonable prejudice or disadvantage in any respect whatsoever.” New York Transportation Law § 102.

We disagree.

Giving island residents and workers priority boarding is not an “undue or unreasonable preference.”

  • It’s all about the phrase “undue or unreasonable”.
  • If the law had been written without that phrase, then the RIOC position would be correct. No common carrier could give any advantage or preference. However, that’s not what the law says. The law appears to envisage some sort of exception as long as it is reasonable (not unreasonable, or not undue). Laws are drafted carefully and thought is given to each word.

The Roosevelt Island Tram is Urban Transportation

  • “The original Roosevelt Island aerial tramway - the first tram in the country to be used for urban transportation – was opened in May 1976” (Source: RIOC website)

The Roosevelt Island Tram has ceased to be available to residents and workers as a reliable method of transportation

  • A combination of factors has led to a massive increase in the use of the tram by tourists, particularly since the tram has recently appeared in a number of popular “Top 10 things to do in NYC” lists and videos. The platforms are crowded and lines often form outside the platform. What used to be the case only during certain limited times of day and certain times of year is virtually now a constant.
  • Island residents and workers now struggle to get on to the tram, often starting in the morning till late into the night. Many people have given up on the tram while others struggle through the chaos
  • This is particularly onerous for our neighbors who may be elderly or unable to walk or stand easily. The island is home to a lot of elderly folks and folks with limited mobility. The same is also true for families with young children.

Priority Boarding for residents and workers is reasonable given the change in ridership

  1. Residents and workers are now excluded from one of their limited modes of transportation to and from home or work, children school, or nearby shopping places. 
  2. The tourists are not using the tram as a mode of urban transportation, but rather as an opportunity to get great pictures of NYC during the crossing. Almost all of the tourists turn around and head straight back to Manhattan. That is tourism, not transportation.

Precedents for this exist, such as:

  • In 1976, “residents were issued priority passes for the tram and a minibus that travels from the tramway station through the island's Main Street.” due to the number of tourists displacing residents. Source: NY Times. 
  • On December 7 2023, Governor Hochul announced preferential treatment for residents of Queens and The Bronx who use the Henry Hudson Bridge and Cross Bay Bridge with a Toll rebate program which is not available for those who do not live in Queens or the Bronx. Release by NY State.

As previously reported, NYC Mayor Eric Adams, NY State Assembly Member Rebecca Seawright, NYC Council Member Julie Menin and former Congresswoman Carolyn Maloney have expressed support for providing some sort of Roosevelt Island Tram boarding preference for residents and workers

During the December 7, 2024 Roosevelt Island Tree Lighting Ceremony, Manhattan Borough President Mark Levine told me he supports a Tram Boarding priority for Roosevelt Island residents and workers too.

5.. 4.. 3.. 2..1, Santa Claus And Mrs Claus Count Down The Lighting Of The Roosevelt Island Christmas Holiday Tree Tonight And Then Jingle Bells

A wonderful, but very cold, Roosevelt Island Christmas Holiday Tree Lighting Ceremony this evening at the Meditation Lawn with performances from the Main Street Theatre & Dance Alliance kids, local Girl Scouts and Roosevelt Island Youth Center.

The enthusiastic crowd, with the help of Roosevelt Island Public Safety Department Deputy Chief Anthony Amoroso chanted for Santa Claus.

Then came the arrival of Santa Claus with Mrs Claus and the countdown to the Lighting of the Roosevelt Island Christmas Holiday Tree began. 5,4, 3, 2, 1 - Lights On,

Nice job by the Roosevelt Island Operating Corp.

Roosevelt Island Operating Corp Announced Today Firing Of President/CEO And General Counsel 11 Months After They Were Placed On Paid Administrative Leave During Internal Investigation Of Workplace Wrongdoing Charges By Staff - Executive Search For New Leadership Begins

Roosevelt Island Operating Corp (RIOC) President/CEO Shelton Haynes and General Counsel Gretchen Robinson have been on paid administrative leave since January 2024 awaiting the outcome of an investigation into charges made by RIOC staff of workplace wrongdoing by Mr Haynes and Ms Robinson.

Last week, a usually reliable Tipster reported that Mr Haynes and Ms Robinson were fired by the RIOC Board of Directors. On November 27, I asked RIOC Board Chairperson/NY State Division Of Homes and Community Renewal Commissioner RuthAnne Visnauskas and the RIOC Board of Directors:

Please confirm the status of RIOC President/CEO Shelton Haynes and General Counsel Gretchen Robinson currently on paid administrative leave pending the results of an internal investigation regarding allegations of wrongdoing on their part.

I was told today that they were both fired from their positions and will not be returning to their prior positions. Is that true?

What were the findings of the investigation?

What if any, is Mr Haynes and Ms Robinson's current position with RIOC?

If they are no longer with RIOC, what is the leadership plan for RIOC?

Please let me know if RIOC will comment on this important issue for the Roosevelt Island community.

Today, the RIOC Board of Directors announced:

As of Monday, November 25th, Shelton Haynes and Gretchen Robinson are no longer employed with the Roosevelt Island Operating Corporation. The Board thanks them for their service to the Roosevelt Island community and wishes them the very best in their future endeavors. The Board will immediately begin an executive search for new leadership. In the interim, RIOC will continue to be led by Vice President and Chief Financial Officer Dhruvika Amin, Acting Chief Operating Officer Mary Cunneen, and Associate General Counsel Lada Stasko until replacements for the CEO and General Counsel positions are secured.

I followed up asking:

Has there been any resolution of the lawsuit?

What were the results of the investigation of charges by staff of wrongdoing by Mr Haynes and Ms Robinson?

There was no additional info from RIOC.

Today, I asked Milton Williams, a partner in the law firm of Walden Macht Harran & Williams, the attorney representing Mr Haynes and Ms Robinson in a racial discrimination lawsuit 

against RIOC and members of NY State Governor Kathy Hochul's staff:

... Do either Mr Haynes, Ms Robinson or yourself have any comment on the firing or any other aspect of this matter including the investigation of staff charges of wrongdoing brought against them and their pending lawsuit against RIOC and members of the Governor's staff...
Mr Williams replied:
On November 22, 2024, Shelton Haynes, former CEO and President, and Gretchen Robinson, former General Counsel of the Roosevelt Island Operating Corporation (RIOC), were unjustly terminated. This can only be viewed as retaliatory for their filing a lawsuit in late 2023 that exposed the systemic and pervasive discrimination and racism that they have endured at the hands of the Executive Chamber for the Office of New York Governor Hochul and RIOC

Fourteen times over the past three years, Haynes and Robinson have been investigated by several New York State entities and two law firms – costing New York taxpayers well more than half a million dollars.

Each and every investigation has found nothing more than unsubstantiated claims and concluded there were no material actionable findings.

These baseless probes, weaponized to undermine their leadership, demonstrate a pattern of retaliation and serve as yet another attempt to silence individuals who stand against injustice, particularly racial injustice. 

This is nothing short of a travesty, Shelton Haynes and Gretchen Robinson have dedicated their careers to public service and served the Roosevelt Island community with integrity and excellence. Instead of addressing their legitimate concerns about systemic issues, they have again and again been met with retaliation and unfounded accusations. The actions taken against them, under the guise of a ‘loss of confidence,’ reflect a disturbing misuse of power that undermines the principles of fairness and justice.

I followed up asking Mr Williams:

Have you received the results of the most recent investigation?

Can you share what it said?

Mr Williams replied:

No findings or report from the last investigation at all. Very different from the Greenberg Traurig report which cleared them. Also, the areas that the recent investigation covered were substantially similar to what Greenberg Traurig cleared them for approximately 18 months ago.

That Time Joe Rogan Visited Roosevelt Island For Fear Factor TV Stunt On The Roosevelt Island Tram - Contestants Dangling Outside Tram Over The East River, Watch What Happens

Before Joe Rogan became an influential podcaster, he was known as a comedian and the host of the NBC TV program Fear Factor where contestants would perform crazy stunts and eat disgusting things.

In 2004, for Fear Factor's 100th episode, the program visited NYC and used the Roosevelt Island Tram for a challenge.

Roosevelt Island Saturday Farmers Market Temporarily Relocating To Winter Home Under The Motorgate Helix Starting Tomorrow, November 30 - Bring Your Food Scraps To The Roosevelt Island Haki Compost Collective At Motorgate Too

The Roosevelt Island Saturday Farmers Market is relocating from Good Shepherd Plaza to their temporary winter home under the Motorgate Helix starting this Saturday, November 30.

According to Farmers Market vendor Israel Wengerd of Wengerd Farms:

The move is necessary to be out of the inclement winter weather.

The Roosevelt Island Farmers Market at Motorgate Plaza under the Helix is open early morning to mid afternoon on Saturdays in good weather and bad offering a wide variety 

of healthy and delicious tasting fruits, vegetables 

and much more.

The Roosevelt Island Haki Compost Collective

Greetings Haki Compost Collective volunteers, friends and droppers,

Your participation creates compost that not only amends our island soil with nutrients but soil with compost retains moisture very well aiding land in times of drought.

Recently we heard Lenape Center leaders present a school curriculum about their history which is being created in partnership with Columbia Teachers College for NYC. During their presentation at the Brooklyn Public Library, they taught words, including Haki - Mother Earth. We are grateful they helped name our Haki compost collective.

Since the re-start on October 5th over 500 drops have been accepted collecting nearly two tons of food scraps! We also welcomed four new volunteers - Etay, Gael, Nick and Volker. And we look forward to growing numbers when the farmers market moves to join us at the Helix / Motorgate area on Saturday, November 30th.

Please spread the word that the green bin program (in partnership with Big Reuse and RIOC) collects food scraps for compost.

Happy Thanksgiving From Roosevelt Island, Tradition, Family, Food, Football, Local History And Alice's Restaurant - Roosevelt Island Pilgrims First Thanksgiving Too

Happy Thanksgiving Day wishes to everyone out there in Roosevelt Island land and elsewhere. 

I hope you all have a wonderful Thanksgiving!!! 

Since Thanksgiving is a day all about about Tradition, here is my traditional Thanksgiving Day post started in 2007:

In addition to family, great food, the Macy's Parade, Miracle on 34th Street, March of the Wooden Soldiers and football, listening to Arlo Guthrie's rendition of Alice's Restaurant on WNEW-FM was, for me, a wonderful Thanksgiving tradition.

A former station DJ remembers Thanksgiving and Arlo Guthrie this way on the blog All Mixed Up Radio.

Every year a couple of days before Thanksgiving, it starts. It's slow at first, and then turns into a non-stop avalanche of phone calls. And no matter how many times a station runs promo announcements telling people exactly when it will be played, the calls still come.
"What time are you playing 'Alice's Restaurant?'"...
Yes, in the olden days people used to listen to music on the radio. Imagine that!...

Roosevelt Island Historical Society President Judy Berdy shares a Thanksgiving story from Roosevelt Island's past when it was known as Welfare Island and housed a penitentiary

Also, former blogger Roosevelt Island 360 tells us about the first Roosevelt Island Thanksgiving in 1975 as reported by the NY Times.

According to the 1975 NY Times article:

One of the nation's newest settlements, a small community of pioneers, is about to celebrate its first Thanksgiving Day on its rockbound island home in the East River.

The situation on Roosevelt Island, which separates midtown Manhattan from Queens, is not quite the same as the one that faced the first New England homeowners centuries ago. The 170 rent‐paying families, the first in the ambitious planned development being built on the island, have not been undergoing hardships. Maybe inconveniences here and there, but not questions of life and death.

Heat comes up (with or without banging the radiator to alert the super, New Yorkstyle). There is light and shelter and the natives are rather nonexistent.

Last night, the new islanders fed one another at an ethnic buffet representing the many diverse strains of humanity they stem from. Tonight there will be an ecumenical service at the Chapel of the Good Shepherd, the church built in 1889 and now put to work as a community center. Tomorrow will be a family day, when people may talk turkey around their tables.
